论我国教师个体惩戒权法律制度的构建

摘要:教师个体惩戒权是教师个体对有越轨行为的学生进行强制性管理的权力。教师个体惩戒权的适用条件为:行使主体必须适格,行使目的应当正当合理,行使对象是学生的越轨行为。教师个体惩戒的方式主要有口头惩戒教育、联系家长并约请家长谈话、“异项偿还法”、剥夺某种特权、暂时收缴代管和短期停课。设立教师个体惩戒法律制度,应明确规定教师个体惩戒权行使的程序。

On the Construction of Legal Institution of Teacher's Individual Right of Discipline in China

Abstract: Teacher's individual right of discipline is the right for the teacher to carry through mandatory management on the student when he has the deviant behavior. The suitable conditions of teacher's individual right of discipline are as follows:the executive subject should be suitable,the executive purpose should be justified and reasonable,the executive object should be the deviant behavior of the student. The main methods of teacher's individual right of discipline are as follows:verbal disciplinary education,communication with the parents,principal of repayment with different projects,deprivation of some privileges,temporary hosted confiscation and temporarily suspend classes. The procedure of exercising the discipline should be clarified to establish legal institution of teacher's individual right of discipline.
