摘 要：人人生而平等是美国宪法确立的准则,然而纵观美国内战后的法律进程,发现作为基本公平权利的教育并不公平。基于法律演化视角,美国促进教育公平发展制度的确立大体可以分为三个阶段,即种族隔离教育争斗中的萌芽时期、教育机会平等博弈中的拓展时期、教育公平制度成型中的完善时期。某种程度上,教育公平不是普遍范畴,往往受到时间与地区的限制,教育公平发展是一个历史进程。

总结：1. 政府管公平、市场管效率是基于教育公平的公共政策的指导原则,补偿性政策则是教育公平发展的核心政策；

2. 法律确立补偿性制度,为弱势群体公平受教育提供制度性的保障;财政提供补偿性资金，为弱势群体公平受教育提供可能性的保证；

3. 美国的教育公平政策取得了某些积极效果,并似乎在某种程度代表了政策发展的普遍趋势,但重要的不仅是理解具体境况中的正确政策,还需了解什么样的情况使得相关政策转化为班级与课堂的实践。

The policy system of promoting educational equity in America

Abstract: It is the principle of American constitution that all men are created equal, but there didn.t exist equal access to education when we look through the historical process of American law since the Civil War. The study finds the institution of promoting educational equity can be divided into three stages, which are the initial stage of racial segregation education battle, the development period of educational equal opportunities struggle, the perfect time of educational equity system establishment. In some extent, educational equity is not universal, which is limited by time and region, and educational equity development is a historical process.
