消极依法治教的文化性反思

摘要:依法治教是我国教育法制建设的重要目标和途径。然而在实践中对于依法治教的消极态度和消极行为却普遍存在,主要包括教育行政部门和学校管理组织的违法违规行为以及社会民众对于教育法律的忽视和违反。虽然从表面看来,造成消极依法治教的局面是由于教育法律的政治地位较低以及政府、社会投
入不足,民众法律意识淡薄,但是如果从文化角度剖析,便会发现在这些制度表征的背后隐藏着更深的社会文化根源。
关键词:消极依法治教;传统文化;大众文化
总结:1、现实中消极依法治教的观念和行为是广泛存在又难以解决,除了政治、经济等因素外,更有其孕育和生存的社会文化根源。
2、消极依法治教的文化消解
(1)弱化教育文化区隔,建立多元文化价值观。
(2)消除符号暴力,加强教育法律话语协商。
总之,应建立各种教育法律主体之间的沟通、监督机制和渠道,以促进各教育法律主体间的社会互动和话语协商,以降低对普通民众的关注成本,在民众
广泛参与的话语机制下推进新型教育法律文化再生产。
The Cultural Reflection of Negative Managing Education by Law

Abstract:Administering education by law is the main goal and means to construct our nation’s educationlegal system.However,the negative attitudes and behaviors to administer education by law are commonly existed,which mainly includes the illegal activities of the department of educational administration and school management organizations,also includes the neglect and violation of people are widespread.Looking from the surface,the negative attitude to administer education by law is caused by the low political status of the education law,the lack of government and social investment,and the public weak awareness of the law,but if parse from a cultural perspective,a deeper social and cultural root which hides behind these systems will be found.
