论我国职业教育立法的完善

摘要：职业教育和培训对于一国劳动者就业能力的提高以及提升整个国家的竞争力至关重要，各国都制定了完备的法律体系加以规范。我国的《职业教育法》存在诸多缺陷和问题，亟需修订。我国职业教育立法应当从改革职业教育模式、明确职业教育法律主体、重建管理体制、保障弱势群体利益、激励社会广泛参与以及完备法律责任等方面加以完善。

关键词：职业教育；职业培训；立法完善

总结：完善我国职业教育立法的建议:

1、我国职业教育和培训法的立法目的应当有: 一是使我国劳动者获得必要的劳动就业技能、知识和能力，并使得必要的职业经验成为可能，二是促进就业

2、改革我国的职业教育模式

3、完善我国职业教育立法的主体，明确其各自的职责、权利和义务

4、建立以自愿为主，强制结合的职业教育制度

5、完善我国的职业教育和培训管理体制。

On Legislative Perfection of China’s Vocational Education

Abstract: Vocational education and training are vital to improve national competitive strength and employment competence，which makes all states establish perfect legal system to regulate．It’s an urgent need to amend our Vocational Education Law for it exists defects and loopholes． It is considered

that to improve this law we have to reform the vocational education mode，clarify legal subjects of vocational education law，rebuild management system，gurantee the benefits of vulnerable group，initiate public participation and perfect legal liability．
