高等学校学生处分正当性论纲

摘要:高等学校学生处分由于涉及到学生受教育权的剥夺与限制、涉及到学生名誉的损害,对其正当性的置疑已经成为当前社会关注的焦点和学界讨论的热点。在正确认识高等学校学生处分的概念与特征的基础上,以目的、实体与程序三个维度为视角,合理剖析高等学校学生处分的正当性,对高等学校学生处分运行机制的合理建构有着重要的意义。目的正当是高等学校学生处分正当性之前提,实体正当是高等学校学生处分正当性之基础,程序正当是高等学校学生处分正当性之保障。而三者的有机统一构成高等学校学生处分正当性的根源。

总结:高校学生处分作为给予学生的具有惩罚性的行政措施,其程序正当性不仅体现在处分权实施的过程中受处分的学生是否受到公平的对待,而且还体现于受处分学生能否获得正当的有效的权利救济。“无救济则无权利。”救济程序不仅是权利必需的保障程序,而且还是权力有效的监督程序。
Justifiale Analysis of the Student Punishment in Higher Education Institutions

Abstract:Because of involving not the deprival and restriction of a student right to accept teaching but the damage of a student reputation,the legitimacy that the university and college punish a student has come to being the focus,being paid close attention from society,and being the hot topic,being get discussion from the academe.
In order to construct and improve the student punishment mechanism,we should reasonable analyze the legitimacy of the student punishment,on the base of the proper analysis on the concept and characteristic of the student punishes and from the purpose,entity and procedure three different dimensions.Firstly,the legitimate
purpose is a preconditions for college and universities to punish a student.Second,the legitimate entity is the foundation of student punishment in university and college.Last but not least,the legitimate procedure is the guarantee for student punishment in university and college.
