论高等教育公平的法律保障——以美国为例

摘 要：美国政府长期致力于通过法律促进和维护高等教育公平，主要措施包括增加学生入学机会、提高相关信息透明度、抑制高校学费上涨、改善高等教育资助方案等，使高等教育体系更符合社会发展的要求。通过多年的发展，美国政府在构建高等教育公平法律保障体系、依法确保低收入家庭学生接受高等教育的机会和权利、促进高等教育信息透明化等方面取得了显著成效。

总结：1. 当从法律视角探讨高等教育公平的意蕴时，它就包括了以下三重内涵：

（1）高等教育公平是个体受教育权保障的问题，即一种基本人权的保障；

（2）高等教育公平是高等教育资源在不同个体之间的分配标准问题!即不同受教育者在接受高等教育过程中所享有的权利或资源究竟依照何种标准进行划分；

（3）高等教育公平是受教育者权利受损时的救济与补偿问题。

2. 美国教育法案对高等教育公平的保障措施：

（1）增加学生入学机会；

（2）提高相关信息透明度；

（3）抑制高校学费上涨；

（4）改善高等教育资助方案。

3. 美国政府以法律保障和促进高等教育公平的理念与经验，为我国完善高等教育立法、实现高等教育公平提供了参考和借鉴：

（1）构建高等教育公平的法律保障体系；

（2）政府在以法律保障高等教育公平上责无旁贷；

（3）以法律增强高等教育重要信息的透明度；

（4）以法律确保基础教育与高等教育有效衔接。

The Legal Safeguard of the Equity in Higher Education—A Case Study of the United States

Abstract: American government has been committed to realizing the equity of higher education through legal procedures in long term. The measures taken include strengthened preparations for the enrollment of financially strapped students enhanced transparency of related information，curbed rising of tuition in colleges，improved grant plan for students，etc.. All of those have made the development of higher education more fitted to society’s demand for greater admission chances and lower tuitions. By the promulgation of related laws, American government has made great contributions to the defending of the opportunities and rights to receive higher education for students from poor families as well as the promotion of transparent educational information.
